BREEZE UP COLLECTION’s (“BREEZE UP COLLECTION”, “www.breezeupcollection.com”, “breezeupcollection.com”, “we”, “us”) website(s) (our “Site” or “Sites”) and related services are made available to you in accordance with the following Terms of Use & Service, and any other rules posted on our Sites (collectively, the “TOS”). Please read the TOS carefully before placing any orders on breezeupcollection.com. We recommend that you keep a copy of the TOS for future reference.

If you are under 16 years of age, you must inform your parent or guardian about BREEZE UP COLLECTION’s Privacy Policy before registering to use this Site or any of its services. We reserve the right to only accept orders from customers aged 18 years or over.

We may modify these Terms of Use & Service from time to time. Please review the TOS regularly, as continued use of the Site constitutes your agreement to any updates or changes.

If you do not agree to any changes made to the TOS, you must immediately stop using the Site.

Any amendments made after you have placed an order will not affect that order unless we are required to make the change by law.

To use some of the services or features made available to you on this Site, you will need to register for an account. When registering, you are required to provide information about yourself that is true, accurate, current, and complete in all respects.

The password you create for your account should be unique and kept secure at all times. You must notify BREEZE UP COLLECTION immediately of any breach of security or unauthorized use of your account.

If you experience any issues with your account or require assistance, please do not hesitate to contact our Customer Care team.

Please note that we can only communicate with the named account holder regarding any questions, changes, or cancellation requests relating to the account.

Forgotten Password

If you have forgotten your password, please follow the FORGOTTEN PASSWORD instructions on the SIGN IN page to reset it.

For security reasons, we are unable to send passwords via email.

ELIGIBILITY TO PURCHASE

PURCHASE ELIGIBILITY

In order to make purchases on the Site, you will be required to provide certain personal details. This includes your real name, phone number, e-mail address, billing information, and any other requested details as indicated during the checkout process.

By placing an order, you represent and warrant that all information provided by you is true, accurate, current, and complete, and that you are the authorized holder of the payment method used.

The Site is available only to individuals and entities that meet BREEZE UP COLLECTION’s eligibility requirements. Customers must possess a valid credit or debit card issued by a bank acceptable to BREEZE UP COLLECTION and authorize us to charge the full purchase amount for any items ordered.

Products purchased through the Site are intended for personal use or gifting purposes only and may not be re-sold, used for commercial purposes, or exploited for any other commercial benefit without prior written permission from BREEZE UP COLLECTION.

BREEZE UP COLLECTION reserves the right to limit or restrict multiple quantities of an item being shipped to a single customer, household, or postal address.

By submitting an order, you expressly authorize BREEZE UP COLLECTION to perform credit and fraud prevention checks where deemed necessary. This may include transmitting or obtaining information about you from third parties, including but not limited to:

  • Credit and debit card verification
  • Identity authentication checks
  • Initial payment authorization
  • Validation of individual purchase transactions
  • Fraud prevention and risk assessment procedures

You further agree that Personal Information provided by you may be used to conduct appropriate anti-fraud checks. Such information may be disclosed to credit reference agencies or fraud prevention agencies, which may keep a record of that information.

ORDERS

ORDER ACCEPTANCE & AVAILABILITY

All orders placed through the Site are subject to acceptance and availability. Items placed in your shopping basket are not reserved and may be purchased by other customers until your order has been completed and confirmed.

BREEZE UP COLLECTION offers products for sale that are in stock and available for dispatch from our distribution centre. However, from time to time, certain items may be awaiting shipment from our suppliers.

In some cases, customers may be offered the opportunity to place an Advance Payment on selected products. By placing an Advance Purchase, you secure priority allocation of that item once stock has been received by BREEZE UP COLLECTION.

BREEZE UP COLLECTION will only accept Advance Purchase orders for stock that has been scheduled for delivery by a supplier. Your statutory rights regarding Advance Purchases remain the same as for any other purchase made through the Site.

Alternatively, customers may choose to register their email address to receive a notification when an out-of-stock product becomes available again.

Products received into stock may be pre-allocated to fulfil Advance Purchase orders. Customers who have made an Advance Payment will receive priority over customers on waiting lists or customers placing standard orders for immediate delivery.

Please note that in some circumstances we may be unable to fulfil Advance Purchase orders due to supplier production delays, manufacturing issues, or quality control concerns identified upon receipt of stock.

Should this occur, we will notify you by email and issue a refund of the Advance Payment to your original payment method within 30 days of confirming that the product is unavailable.

If you have registered for stock notifications, we will endeavour to notify you by email within 48 hours of the selected product becoming available on the Site.

Please be aware that products in particularly high demand may sell out before you are able to complete your purchase.

BREEZE UP COLLECTION will retain a record of your transactions for a minimum period of one year.

PRICING POLICY

PRICING & PAYMENT

All prices displayed on the Site are shown in Euro (€) and are inclusive of VAT at the applicable rate unless you have selected a delivery country where VAT is not chargeable.

All prices and promotional offers remain valid as advertised from time to time.

The Euro price displayed for a product at the time your order is accepted will be honoured, except in cases of obvious pricing or typographical errors.

Prices may change periodically due to factors including, but not limited to:

  • Currency exchange rate fluctuations
  • Seasonal markdowns or promotions
  • Commercial or supplier pricing adjustments

The price applicable to your purchase will be the price displayed at the time your order is accepted and processed.

Delivery Duties & Taxes

Customers purchasing from countries classified as Delivery Duty Paid (DDP) destinations will have all applicable import duties and taxes included within the final purchase price.

Customers purchasing from countries classified as Delivery Duty Unpaid (DDU) destinations will be charged for the products purchased and shipping costs only.

Any applicable import duties, customs charges, local taxes, or clearance fees for DDU shipments will be invoiced directly to you by the courier service or by an import broker appointed on your behalf.

We strongly recommend contacting your local customs authority prior to purchase in order to determine the estimated landed cost of your order.

Currency Conversion

If your credit or debit card is not denominated in Euro (€), the final amount charged may vary depending on the exchange rate applied by your card issuer on the date the transaction is processed.

BREEZE UP COLLECTION is not responsible for any additional bank charges, exchange rate fluctuations, or foreign transaction fees applied by your payment provider.

ACCEPTANCE OF YOUR ORDER

ORDER ACCEPTANCE & CONTRACT FORMATION

Once you have placed your order, you will receive an email acknowledging receipt of your order and confirming the details submitted. This email does not constitute acceptance of your order and is provided for information purposes only.

Unless you cancel your order in accordance with your statutory rights, acceptance of your order and completion of the contract between you and BREEZE UP COLLECTION will occur only when we send you an email confirming that your goods have been dispatched.

The contract for sale is concluded in Wexford, Ireland, and the language of the contract is English.

Please note that neither our third-party payment processors nor our nominated courier services have authority to accept orders on behalf of BREEZE UP COLLECTION.

Right to Refuse Orders

BREEZE UP COLLECTION reserves the right not to accept or fulfil an order for reasons including, but not limited to:

  • Failure to obtain payment authorization
  • Shipping restrictions applying to a particular item or destination
  • Products being out of stock
  • Items failing quality control checks
  • Failure to meet eligibility criteria outlined within these Terms of Service

We may also refuse to process a transaction or provide service to any customer at our sole discretion and at any time.

BREEZE UP COLLECTION shall not be liable to you or any third party for:

  • Removing products from the Site
  • Removing or editing Site content or materials
  • Refusing to process a transaction
  • Cancelling or suspending transactions after processing has commenced

Pricing Errors

While every effort is made to ensure that all product descriptions, imagery, and pricing on the Site are accurate, errors may occasionally occur.

If we discover an error in the price of a product you have ordered, we will notify you as soon as possible by email or telephone.

BREEZE UP COLLECTION is under no obligation to accept or fulfil an order for a product advertised at an incorrect price and reserves the right to cancel such orders, even if payment has already been taken or the order is in transit.

If payment has already been processed for an incorrectly priced product, we will issue a full refund to your original payment method as soon as reasonably possible.

Where products are recalled while in transit, refunds will be processed once the goods have been returned to us.

  • Any additional payment methods clearly advertised on the Site from time to time

PayPal Payments

If you choose to pay using PayPal, you will be redirected to the PayPal website during checkout where you can securely log in, review your order total, and complete payment by selecting “Pay Now”.

Once your PayPal transaction has been successfully completed, you will automatically be returned to www.breezeupcollection.com.

Payment Authorization

Payment will be debited and cleared from your account once your order has been dispatched by BREEZE UP COLLECTION.

By placing an order, you confirm that:

  • The credit or debit card being used belongs to you, or
  • You have been specifically authorised by the cardholder to use the payment method

All credit and debit card holders are subject to validation checks and authorization by the relevant card issuer.

If the issuer of your payment card refuses authorization, BREEZE UP COLLECTION will not be liable for any delays or failure to deliver your order.

Website Security

To help ensure your shopping experience is safe, simple, and secure, BREEZE UP COLLECTION uses Secure Socket Layer (SSL) encryption technology.

We take reasonable care, insofar as it is within our power to do so, to maintain the security of your order and payment details.

However, except in cases of negligence on our part, we cannot be held liable for any loss you may suffer if a third party gains unauthorized access to data provided by you when accessing or ordering from the Site.

GIFT CARDS

GIFT CARD TERMS & CONDITIONS

Buying a Gift Card

If you are purchasing a virtual Gift Card for someone, it will be emailed directly to the recipient once your order has been processed and payment has been successfully received. A confirmation copy will also be sent to you.

If you are purchasing a physical Gift Card, it will be posted to the recipient after your order has been processed and payment has been received. A dispatch confirmation email will also be sent to you.

Please note that shipping charges apply to physical Gift Cards and will be calculated at checkout.

We are not responsible for failed or incorrect delivery of virtual or physical Gift Cards due to inaccurate, incomplete, or outdated information provided by the purchaser. It is your sole responsibility to ensure that all recipient details are correct.

BREEZE UP COLLECTION accepts no responsibility for Gift Cards that are lost, stolen, destroyed, or used without permission.

We reserve the right to cancel or refuse any Gift Card transaction where we believe such action is necessary.

Promotional or discount codes cannot be used when purchasing Gift Cards, except for free shipping codes applicable to physical Gift Card orders unless otherwise stated.


Using a Gift Card

Gift Cards are valid for 12 months from the date of purchase.

Gift Cards may be redeemed against all products available on:

Gift Cards are non-transferable and may only be redeemed on www.breezeupcollection.com. They cannot be redeemed on any other website owned or operated by Celtic Equine Supplies Ltd or any affiliated company.

Gift Cards cannot be exchanged for cash, credit, or alternative products.


Remaining Gift Card Balance

If your order total is less than the value of your Gift Card, any remaining balance will automatically be credited to your account as store credit for future purchases.

You may check your Gift Card or store credit balance via your “My Account” page.

If you do not already have an account on www.breezeupcollection.com, a temporary account may be created using the email address provided during checkout in order to store your remaining balance.

To access this temporary account, you will need to:

  • Use the email address entered during checkout
  • Follow the “Reset Password” instructions
  • Create a new password to access your account and balance

Orders Exceeding Gift Card Value

If your order total exceeds the value of your Gift Card, any available store credit on your account will automatically be applied first.

If there is still an outstanding balance remaining after Gift Card and store credit redemption, payment must be completed using an accepted credit or debit card.


Refunds for Purchases Made with Gift Cards

If you return items purchased using a Gift Card, refunds will be issued as store credit to your account for use on future purchases.

If you do not already have an account, a temporary account may be created in order to hold your refund balance as store credit.

You can access this account using the email address entered during checkout and by following the “Reset Password” instructions.


Additional Terms

All purchases made using a Gift Card are subject to the general Terms & Conditions and policies available on www.breezeupcollection.com.

BREEZE UP COLLECTION reserves the right to amend or update these Gift Card Terms & Conditions at any time without prior notice.

Please refer to our Privacy Policy for information on how personal data relating to Gift Cards is collected, processed, and stored.

These Terms & Conditions are governed by and construed in accordance with the laws of Ireland.

Any disputes arising in relation to Gift Cards, including non-contractual disputes, shall be subject to the exclusive jurisdiction of the Irish courts.

PROMOTION CODES

Promotion codes are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided.

INSURANCE AND DELIVERY

You will own the goods on and from the later of the point in time when: (a) we receive payment in full, or (b) we deliver the goods to you.

BREEZE UP COLLECTION insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by BREEZE UP COLLECTION, and transfer of responsibility in the same way. The goods are your responsibility from the time we deliver them to the address you gave us.

Our couriers can deliver to certain destinations without collecting a signature. If this option applies to your delivery address, you can update your preference on the shipping page at checkout before proceeding to purchase. Please note, that if no signature is collected, you agree to our terms and conditions and, confirm that BREEZE UP COLLECTION can leave your package(s) outside the premises at the shipping address provided by you without obtaining a signature for proof of delivery and take full responsibility for any loss or damage that may occur. On occasion, our couriers may refuse to deliver your order if they are of the opinion that the shipping address is considered to be unsafe.

Please note that we aim to dispatch all orders within 24 hours, or 48 hours during sale periods. Delivery times appearing on the site are estimates and are to be used as a guide only and commence from the date of dispatch. In any event, we will deliver the goods to you within 30 days of the day on which we accept your order. BREEZE UP COLLECTION is not responsible for any delays caused by destination customs clearance processes.

If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel your order and we will give you a refund for any goods you have paid for but not received.

RETURNS AND EXCHANGES

CANCELLING YOUR ORDER UNDER THE CONSUMER CONTRACTS (INFORMATION, CANCELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013

If you are based in the EU under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (ICACRs), you have the right to cancel your order with us provided you give us written notice.

Right to Cancel under the ICACRs

You have the right to cancel your order within 14 days without giving any reason.

The cancellation period will expire 14 days from the day after the day on which you (or someone you nominate, other than a carrier) receives the last of the goods.

For orders cancelled under the ICACRs, we will issue you with a full refund including the shipping cost paid by you. We may make a deduction from the reimbursement for loss in value of any goods supplied, if the loss is the result of unnecessary handling by you.

We will make reimbursement without undue delay, and not later than:
(i) 14 days after the day we receive back from you any of the goods supplied; or
(ii) (if earlier) 14 days after the day you provide us with evidence that the good have been returned; or
(iii) if no goods were supplied, 14 days after the day on which we are informed about your cancellation.

We will make reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the re-imbursement.

In the event that we have sent goods to you and you have cancelled your order, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back, whichever is the earliest. If we do not receive the goods back, we may arrange to have them collected from you at your cost.

without undue delay and in any event not later than 14 days from day on which you communicate your cancellation of the contract to us. The deadline is met if you send the goods before the period of 14 days has expired.

You will have to bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling, other than what is necessary to establish the nature, characteristics and functioning of the goods.

Please note you may only use your right to cancel the order under the ICACRs if you give us formal written notice of cancellation any time after your order has been placed, up until 14 calendar days from the day after you receive your order, by email or post as described above.

RETURNS USING OUR 30-DAY RETURNS GUARANTEE

As an alternative to using your rights under the ICACRs, you may prefer to return items using our 30 day returns service. Simply send your unwanted items back to us within 30 days for a refund of the value of the item. If you wish to exchange your item for an alternative product, we suggest that you return it for a refund and purchase the new item separately.

Items must be returned to us unused with all BREEZE UP COLLECTION tags and all labels still attached. Returns that do not meet our policy will be sent back to you.

RETURNS POLICY

To ensure your return is covered by our guaranteed returns policy and reaches us promptly, items must be returned from the same country to which they were delivered. Orders sent back from a different destination may incur additional charges or be delayed by customs.

We prefer that items are returned to us using the same delivery bag in which they were sent to you. Simply place the items in the bag, together with your invoice and seal. Unidentified returns will be returned to the sender.

Shipping is at your own cost.

Returns that are damaged or soiled will not be accepted and will be sent back to the customer and/or a refund refused.

Boots and Shoes
All footwear should only be tried on a carpeted surface before wear.

Faulty goods
Goods are classified as faulty if they are not of satisfactory quality, fit for purpose or as described. Please note that items which are damaged or as a result of normal wear and tear; by accident; or through misuse will not be considered faulty. If your item is faulty when you receive it, you can return it for a refund within 30 days from the date you received it.

Colours
We have made every effort to display as accurately as possible the colours of our products that appear on BREEZE UP COLLECTION. However, as computer monitors vary, we cannot guarantee that your monitor’s display of any colour will be completely accurate.

REPEATED RETURNS
We offer a flexible returns policy to make your online shopping experience even easier. We do monitor the number of returns made by customers, and continued returns will be flagged and may, at our discretion, lead to the closure of your BREEZE UP COLLECTION account or future orders being refused.

NON-BREEZE UP COLLECTION RETURNS
Please be aware that we will not be responsible for any items that are returned to us which were not purchased from BREEZE UP COLLECTION. This includes personal items as well as items which may have been purchased from other third-party companies. These items are returned and then held by us entirely at your own risk. It is your responsibility to contact us in order to arrange their return. In such circumstances, we reserve the right to charge you an additional charge for this return. Please note that we will only ever be able to return the items to you, not to any third-party company. Please also be aware that we make no commitment to hold these items for any set period of time, and so we reserve the right to dispose of these items as we deem fit.

INTELLECTUAL PROPERTY RIGHTS

Your use of the Site and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the Content (as described in the Content section below), including BREEZE UP COLLECTION Software and all HTML and other code contained in this Site. All such Content including third party trademarks, designs, and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorized by BREEZE UP COLLECTION and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited. However, you are permitted to make one copy for the purposes of viewing Content for your own personal use.

CONTENT

In addition to the Intellectual property rights mentioned above, “Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this Site. BREEZE UP COLLECTION tries to ensure that the information on this site is accurate and complete. BREEZE UP COLLECTION does not promise that BREEZE UP COLLECTION’s Content is accurate or error-free. BREEZE UP COLLECTION does not promise that the functional aspects of the Site or BREEZE UP COLLECTION’s Content will be error free or that this Site, BREEZE UP COLLECTION Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.

NO COMMERCIAL USE

This Site is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, data mine or sell any Content, software, products, or services contained within this Site. You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site.

YOUR ACTIVITY

You agree that you will be personally responsible for your use of this Site and for all of your communication and activity on and pursuant to this Site. If we determine that you are or have been engaged in prohibited activities, were not respectful of other users, or otherwise violated the TOS, we may deny you access to this Site on a temporary or permanent basis.

THIRD PARTY SITES

We may include hyperlinks on this Site to other websites or resources operated by parties other than BREEZE UP COLLECTION, including advertisers. BREEZE UP COLLECTION has not reviewed all of the sites linked to its Web Site and is not responsible for the content or accuracy of any off-site pages nor are we responsible for the availability of such external websites or resources, and do not endorse and are not responsible or liable, directly or indirectly, for the privacy practices or the content of such websites, including (without limitation) any advertising, products or other materials or services on or available from such websites or resources, nor for any damage, loss or offence caused or alleged to be caused by, or in connection with, the use of or reliance on any such content, goods or services available on such external websites or resources.

YOUR RIGHTS

You have certain rights under the law, including:

That any products you order through this Site will be of satisfactory quality, fit for their intended purpose, and will conform to any description given on this Site;
Certain remedies if a product is defective; and
A right to cancel any order for a product within 14 days after the date of receipt of the product and receive a full refund even if it is not defective (see Cancelling your order above).
Nothing in the TOS is intended to affect these rights. For more information about your rights contact your local Citizens Information Office.

LIMITS ON OUR LIABILITY

We accept liability for death and personal injury arising from our negligence or that of our employees and agents. We do not seek to exclude our liability for fraudulent misrepresentation by us or our employees or agents.

Nothing in this Agreement is intended to affect your rights under the law (see “Your Rights” above).

If BREEZE UP COLLECTION fails to comply with the TOS, we are responsible for loss or damage you suffer as a foreseeable result of us breaching the TOS. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract is made, both you and BREEZE UP COLLECTION knew it might happen, for example, if you discussed it with us during the sales process. We will only be liable for loss or damage up to 150% of the total value of goods purchased.

We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you and us (for example, loss of profits or loss of opportunity).

We are also not responsible for failure to meet any of our obligations under the TOS where such failure is due to events beyond our reasonable control.

COMPENSATION

At our request, you agree to compensate us fully, defend us, and hold us BREEZE UP COLLECTION harmless immediately on demand, its officers, directors, agents, affiliates, licensors, and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the TOS by you, including the use by any other persons accessing this Site using your Internet account caused by your action or inaction.

OUR RELATIONSHIP

You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and BREEZE UP COLLECTION as a result of the TOS or your use of this Site. You agree that you may not and will not hold yourself out as a representative, agent, or employee of BREEZE UP COLLECTION, and we shall not be liable for any representation, act, or omission on your part.

NO WAIVER

The TOS together with all our policies and procedures will be governed by and construed in accordance to Irish law and the relevant courts of Ireland will have exclusive jurisdiction.
